Important Notice: Please read this User Agreement carefully before using lovemurmurAPP (hereinafter referred to as "the Application"). This Agreement is a legal agreement between you and the Operator of lovemurmurAPP. If you do not agree to any terms of this Agreement, please do not use the Application. By using the Application, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
This Agreement sets forth the rights and obligations between the Operator of lovemurmurAPP and the user regarding the "lovemurmur" software services (hereinafter referred to as "the Services"). "User" refers to any individual who downloads, installs, registers, logs in to, or uses (collectively "Uses") the Services.
The main features of the Application include:
To provide better services or due to changes in laws and regulations, policies, technical conditions, product functions, etc., this Agreement may be revised and updated by the Operator as appropriate. The revised content shall form an integral part of this Agreement. After the Agreement is updated, the Operator will notify users of the updated content via in-app announcements or other appropriate means. The revised Agreement shall take effect from the date of publication. Continued use of the Services constitutes acceptance of all revised terms.
1.1 Users need to register a "lovemurmur" account before using the Services. The Application currently only supports registration using a valid email address.
1.2 Users shall provide truthful, accurate, and complete personal information during registration and keep such information up to date. You need to provide a valid email address as your login credential and set a secure password.
1.3 The account name, avatar, profile, and other registration information and personal information set by the user must comply with laws and regulations and shall not impersonate others (including but not limited to using names, titles, logos, portraits, or other methods that may cause confusion) or engage in malicious registration activities (e.g., frequent/batch registration).
1.4 After registration is complete, you will receive a verification email. Please follow the instructions in the email to complete the email verification to ensure account security. Accounts that have not completed email verification may not be able to use some features.
1.5 According to the legal requirements of the user's country/region, we may implement age verification mechanisms. The user warrants that they meet the minimum age requirement for using the Application.
1.6 One email address can only be used to register one account. If multiple accounts are found to be registered with the same email address, the Operator reserves the right to merge or disable the relevant accounts.
2.1 The specific content of the Services is provided by the Operator based on actual circumstances, including but not limited to authorizing users to control compatible smart devices through their accounts, sharing content, and community interaction. To better enhance user experience and services, the Operator will periodically change the services it provides (including but not limited to software modifications, upgrades, feature enhancements, development of new services, software replacements, etc.). Users will be notified of service changes by the Operator (including but not limited to system prompts, announcements, in-app messages, etc.).
2.2 The Operator grants the user a personal, revocable, non-transferable, non-exclusive, and non-commercial license to lawfully use the lovemurmur software and related services. All other rights not expressly granted herein are reserved by the Operator. Users must obtain separate written permission from the Operator before exercising such rights. The Operator's failure to exercise any such right shall not constitute a waiver of that right.
2.3 This Application is free and currently does not contain any paid features. If paid features are introduced in the future, users will be notified separately and this Agreement will be updated accordingly.
3.1 The Operator will handle user personal information in accordance with the lovemurmur Privacy Policy. That policy contains complete terms regarding the types of personal information, collection scenarios, purposes of use, sharing rules, and methods for users to exercise their rights. Users should read it thoroughly and provide independent authorization.
3.2 The Operator values the protection of personal information and will take technical measures and other necessary steps to ensure the security of user personal information, preventing the leakage, damage, or loss of user personal information collected during the Services. In the event of such a situation or if the Operator discovers a potential risk of such a situation, the Operator will promptly take remedial measures and inform the user. Users must also immediately contact the Operator if they discover such a situation.
3.3 The Operator will not disclose or reveal user personal information to any third party without user consent, except in the following circumstances:

3.5 Except for the matters listed above, the Operator will not use user personal information for any other purposes without the user's prior consent.
3.6 The Operator values the protection of minors. Any user who does not meet the minimum age requirement stipulated by the laws of their country/region is prohibited from registering an account or using the Services.
3.7 The Operator warrants that it will collect, use, or disclose user personal information in accordance with the principles of legality, legitimacy, and necessity, and will not collect user personal information unrelated to the services provided.
4.1 The term "content" herein refers to any content created, uploaded, copied, published, or disseminated by the user while using the Services, including but not limited to account avatars, names, user descriptions, and other registration information and verification materials, or text, voice, images, videos, graphics, messages sent, replied to, or auto-replied, related link pages, and other content generated by using the account or the Services.
4.2 When using the Application, users must comply with the lovemurmur Community Guidelines. Users shall not use the "lovemurmur" account or the Services to create, upload, copy, publish, or disseminate content that violates the Community Guidelines.
4.3 It is specifically emphasized that the Application strictly prohibits any form of pornography, nudity, or adult-themed content. Users must ensure that the content they publish is suitable for users of all ages, maintaining a healthy and positive community atmosphere.
4.4 Users shall not use the "lovemurmur" account or the Services to create, upload, copy, publish, or disseminate content that interferes with the normal operation of the Application or infringes upon the legitimate rights and interests of other users or third parties.
5.1 Any content transmitted or published by the user in or through the Services does not reflect or represent, nor shall it be deemed to reflect or represent, the views, positions, or policies of the Operator, and the Operator assumes no responsibility for such content.
5.2 Users shall not use the "lovemurmur" account or the Services to engage in the following activities:
5.3 Users are solely responsible for the truthfulness, legality, harmlessness, accuracy, and validity of the information transmitted using the "lovemurmur" account or the Services. Any legal liability related to the information disseminated by the user shall be borne by the user independently, and the Operator shall not be held liable. If damage is caused to the Operator or any third party as a result, the user shall compensate accordingly according to law.
5.4 The services provided by the Operator may include advertisements. The user agrees to display advertisements provided by the Operator and third-party suppliers or partners during use. Except where expressly stipulated by laws and regulations, users shall be solely responsible for any transactions conducted based on such advertising information. The Operator shall not be liable for any loss or damage suffered by the user due to transactions conducted based on such advertising information or content provided by said advertisers.
5.5 Unless permitted in writing by the Operator, users shall not engage in any of the following acts:
6.1 Ownership of the "lovemurmur" account belongs to the Operator. Upon completing the application and registration process, the user obtains the right to use the "lovemurmur" account. This right to use belongs solely to the initial applicant and registrant and is prohibited from being gifted, lent, rented, transferred, or sold. If the Operator discovers or has reasonable grounds to believe that the user is not the initial registrant of the account, to ensure account security, the Operator has the right to immediately suspend or terminate services to that registered account and may permanently disable the account.
6.2 Users can query, change, or delete personal information, registration information, and transmitted content on the "lovemurmur" account through the profile settings page within the Application. Please note that deleting relevant information will also delete the text and images stored by the user in the system.
6.3 Users are responsible for properly safeguarding their registered account information and account password security. Losses suffered due to improper user safeguarding, such as account theft or password compromise, shall be borne by the user. Users are legally responsible for activities under their registered account and password. Users agree not to use other users' accounts or passwords under any circumstances. If users suspect that others are using their account or password, they agree to notify the Operator immediately.
6.4 If you forget your password, you can reset it using the email address used during registration. Please ensure the security of your email to prevent unauthorized access.
6.5 Users shall comply with all terms of this Agreement and use the Services correctly and appropriately. If a user violates any terms of this Agreement, the Operator has the right to interrupt or terminate services to the violating user's "lovemurmur" account after notifying the user.
6.6 Users can apply to delete their account within the Application. After deletion is completed, the Operator will delete user data in accordance with the law (except where laws and regulations require storage). Users understand that deletion does not exempt them from legal liability related to their actions before deletion. If the account is involved in a dispute (e.g., being reported, involved in litigation, or under administrative investigation), the Operator has the right to terminate the deletion process.
7.1 The user understands and agrees that "lovemurmur" merely provides a platform for device control, information sharing, transmission, and acquisition. The user is solely responsible for all actions under their registered account, including any content they transmit and any consequences arising therefrom. Users should exercise their own judgment regarding the content on "lovemurmur" and in the Services and assume all risks arising from the use of such content, including risks arising from reliance on the correctness, completeness, or usefulness of the content. The Operator cannot and will not be liable for any loss or damage resulting from user behavior.
7.2 If a user discovers anyone violating this Agreement or using the Services in an otherwise improper manner, please report or complain to the Operator immediately. The Operator will handle the matter in accordance with this Agreement.
7.3 The user understands and agrees that, due to business development needs, the Operator reserves the right to unilaterally change, suspend, terminate, or revoke all or part of the Services.
8.1 Except for the intellectual property rights in advertisements involved in the Services, which belong to the respective advertisers, the intellectual property rights in the content provided by the Operator in the Services (including but not limited to web pages, text, images, audio, video, charts, etc.) belong to the Operator, unless the user had legally obtained intellectual property rights for the content they published before using the Services.
8.2 Unless otherwise stated, the copyrights, patent rights, and other intellectual property rights in the software underlying the Services provided by the Operator belong to the Operator.
8.3 The graphics, text or their combinations, and other Operator logos, product names, and service names (collectively referred to as "Operator Marks") involved in the Services are owned by the Operator. Without the prior written consent of the Operator, users shall not display, use, or otherwise handle the Operator Marks in any way, nor indicate to others that they have the right to display, use, or otherwise handle the Operator Marks.
8.4 The aforementioned and any other intellectual property rights legally owned by the Operator or relevant advertisers are protected by law. Without the written permission of the Operator or relevant advertisers, users shall not:
9.1 The Operator has the right to take the following measures against violating accounts based on the severity of the circumstances: warning, content removal, functional restriction (partial/full), service termination, permanent suspension. Users shall bear the consequences, such as restricted access to account assets or services, resulting from the aforementioned measures.
9.2 Users suspended for violating the User Agreement can log in to their account to check the suspension period and will be automatically reinstated upon expiry of the suspension period. Users subject to functional restrictions will automatically regain the restricted functions after the restriction period ends. Suspended users may submit an appeal to the Operator. The Operator will review the appeal and, at its reasonable discretion, decide whether to change the penalty measures.
9.3 The user understands and agrees that the Operator has the right to take appropriate actions against any user who violates relevant laws, regulations, or the provisions of this Agreement based on reasonable judgment, and to preserve relevant information and report to relevant departments in accordance with laws and regulations. The user shall bear all legal liabilities arising therefrom.
9.4 The user understands and agrees that if the user violates this Agreement, resulting in any claims, demands, or losses asserted by any third party, including reasonable attorney fees, the user shall indemnify the Operator, its affiliated companies, and partners and hold them harmless.
10.1 The user understands and confirms that during the use of the Services, they may encounter risk factors such as force majeure, causing interruption of the Services. Force majeure refers to unforeseeable, unavoidable, and insurmountable objective events that have a significant impact on one or both parties, including but not limited to natural disasters such as floods, earthquakes, epidemics, and storms, as well as social events such as wars, riots, and government actions. In such events, the Operator will endeavor to coordinate with relevant parties promptly to make repairs. However, losses caused to users or third parties thereby shall be exempted for the Operator and its partners to the extent permitted by law.
10.2 Like most internet services, the Services are subject to various factors including but not limited to user reasons, network service quality, and social environment, and may be invaded by various security issues, such as others using the user's information to cause harassment in real life; viruses contained in other software downloaded by the user or other websites visited, threatening the security of the user's computer information and data, thereby affecting the normal use of the Services, etc. Users should enhance awareness of information security and protection of user data, pay attention to strengthening password protection to avoid losses and harassment.
10.3 The user understands and confirms that the Operator shall not be liable for losses caused by force majeure (including natural disasters, government actions, basic network failures), third-party virus attacks, or the user's own negligent actions during the use of the Services.
10.4 The user understands and confirms that during the use of the Services, there may be information from others that is misleading, deceptive, threatening, defamatory, offensive, or illegal, or information that infringes upon others' rights anonymously or by impersonation, along with behaviors accompanying such information. Therefore, the Operator shall not be liable for any loss to the user or any third party resulting therefrom.
10.5 The user understands and confirms that the Operator needs to perform regular or irregular maintenance or repair on the "lovemurmur" platform or related equipment. If the Services are interrupted for a reasonable time due to such circumstances, the Operator shall not be liable, but the Operator shall give prior notice.
10.6 The right of the Operator to handle illegal, non-compliant, or违约 content obtained in accordance with laws, regulations, and this Agreement does not constitute an obligation or commitment of the Operator. The Operator cannot guarantee timely discovery of illegal, non-compliant, or违约 behaviors or corresponding handling.
10.7 The user understands and confirms that the Operator shall not be liable for any loss caused by quality defects in the following products or services provided by the Operator to the user:
10.8 In no event shall the Operator be liable for any indirect, consequential, punitive, incidental, special, or exemplary damages, including loss of profits suffered by the user due to using "lovemurmur" or the Services (even if the Operator has been advised of the possibility of such damages). Notwithstanding any contrary provision in this Agreement, the Operator's total liability to the user for any cause whatsoever, and regardless of the form of action, shall at all times be limited to the amount paid by the user to the Operator for using the services provided by the Operator (if any).
11.1 Given the special nature of network services, the user agrees that the Operator has the right to modify, interrupt, or terminate part or all of the Services as necessary. For services that are modified, interrupted, or terminated, the Operator shall notify users before the modification, interruption, or termination and shall provide affected users with equivalent alternative services (if possible).
11.2 If any of the following circumstances occurs, the Operator has the right to modify, interrupt, or terminate services provided to the user without bearing any liability to the user or any third party:
12.1 The Operator solemnly reminds users to pay attention to the clauses in this Agreement that exempt the Operator from liability and limit user rights. Please read carefully and consider the risks independently.
12.2 The validity, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the user's country/region or laws otherwise agreed upon by both parties. If any dispute or controversy arises between the user and the Operator, the parties shall first attempt to resolve it through friendly negotiation. If negotiation fails, the user agrees to submit the dispute or controversy to the competent people's court in the jurisdiction of the Operator's principal place of business, or resolve it through arbitration as agreed by both parties.
12.3 If any provision of this Agreement is invalid or unenforceable for any reason, the remaining provisions shall remain valid and binding on both parties.
12.4 The terms listed in this Agreement signed by the user and the Operator may not fully enumerate and cover all rights and obligations between the user and lovemurmur, and existing agreements may not fully meet future development needs. Therefore, the lovemurmur Privacy Policy, lovemurmur Community Guidelines, etc., are supplementary agreements to this Agreement, inseparable from this Agreement and having the same legal effect. By using the lovemurmur platform services, the user is deemed to have agreed to the above supplementary agreements.
